Swingtap Terms of Use

Effective Date: January 1, 2026

These Terms of Use (“Terms”) govern your access to and use of Swingtap, located at swingtap.fun (the “Platform”), operated by Swingtap (“Swingtap,” “we,” “us,” or “our”). The Platform is an age-restricted social networking and profile-sharing service for consenting adults.

IMPORTANT NOTICE – ADULTS ONLY:

The Platform is intended exclusively for users who are 18 years of age or older (or the age of majority in your jurisdiction, whichever is higher). By accessing or using the Platform, you represent and warrant that you meet this requirement.

If you do not agree to these Terms, do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, browsing, or using any part of the Platform, you agree to be bound by these Terms and by our Privacy Policy (the “Privacy Policy”), which is incorporated by reference.

If you are using the Platform on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility, Age Verification, and Adult Content

2.1 Eligibility. You must be at least 18 years old (or the age of majority where you live, whichever is higher) to use the Platform.

2.2 Age Verification. We may use reasonable measures to verify age and may require additional verification at any time. We may suspend or terminate accounts if we cannot verify eligibility.

2.3 Adult-Oriented Platform. The Platform may contain content and user profiles that reference adult themes and lifestyle preferences. You acknowledge and accept this as a condition of using the Platform.

2.4 No Minors / CSAM. You may not post, upload, share, request, or depict any person under 18 (or the age of majority) in any manner. Any suspected child sexual exploitation material (“CSAM”) will be removed and reported to appropriate authorities.

3. Accounts, Security, and Responsibility

3.1 Account Registration. To access certain features, you must create an account and provide accurate, complete, and current information.

3.2 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.3 Impersonation and Misrepresentation. You may not impersonate others or misrepresent your identity, age, relationship status, or intent. You may not use the Platform for deception, fraud, coercion, or harassment.

3.4 One Person, One Account (Optional). We may limit users to one account per person and may remove duplicate accounts at our discretion.

4. Paid Access, Billing, and Refunds

4.1 Paid Access and Add-Ons. Some features may require payment (for example, time-limited access to certain Platform features and/or optional add-ons, including physical accessories). Pricing and access details are displayed at the point of purchase.

4.2 Payment Processing. Payments are processed by third-party payment processors. We do not store full payment card numbers.

4.3 Access Period; No Automatic Charges. If you purchase time-limited access, the access period and scope are shown at checkout. You will not be charged again unless you initiate a new purchase. Access may expire at the end of the purchased period unless you make another purchase.

4.4 Billing Errors. If you believe a charge is incorrect or unauthorized, contact us at sales@swingtap.fun promptly with transaction details.

4.5 Refund Policy (General). Except where required by law, purchases are non-refundable. Swingtap may, in its sole discretion, issue refunds or credits in limited circumstances.

4.6 Refund Policy – Physical Add-Ons (Returns and Refunds). If you purchase a physical add-on from Swingtap (including NFC-enabled accessories), you may request a return subject to the conditions below:

Return Window: Return requests must be submitted within thirty (30) days of delivery.
Condition Requirements: Items must be unused, in original condition, and returned in original packaging (including all accessories and inserts). For hygiene/safety and anti-tampering reasons, Swingtap may refuse returns for items that appear used, damaged by the customer, missing components, or not in original condition.
Non-Returnable Items: Clearance/final-sale items (if designated at checkout), and personalized/custom items (if offered).
Shipping Costs: Original shipping/handling fees (if any) are non-refundable unless required by law. Customer is responsible for return shipping unless the return is due to a verified defect or an error by Swingtap.
Refund Timing: Approved refunds are issued to the original payment method after the returned item is received and inspected. Processing times vary by payment processor/bank.

4.7 Damaged, Defective, or Incorrect Items. If your physical add-on arrives damaged, defective, or incorrect, contact sales@swingtap.fun within seven (7) days of delivery and include your order number and clear photos of the item and packaging. Where verified, we will provide a replacement or, at our discretion, a refund or credit.

4.8 Taxes. You are responsible for any applicable taxes or fees imposed by your jurisdiction.

5. Profile Visibility, Sharing, and Discretion

5.1 Sharing Functionality. The Platform is designed to enable you to share your profile (for example via link/QR code and optional NFC-enabled accessories). You control who you share with, and you are responsible for any consequences of sharing your profile information.

5.2 No Guarantee of Privacy After Sharing. While we may implement technical measures intended to limit search engine indexing or public discovery, we cannot guarantee that any content you share will remain private once displayed to another person (for example, screenshots, re-sharing, or recordings).

6. User Content and Content License

6.1 User Content. You may upload or submit content, including photos, text, preferences, and other materials (“User Content”). You retain ownership of your User Content as between you and Swingtap.

6.2 License to Swingtap. By submitting User Content, you grant Swingtap a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, publish, and distribute your User Content solely as necessary to operate, provide, maintain, and improve the Platform and to enforce these Terms.

6.3 Your Representations. You represent and warrant that you own or have the necessary rights to your User Content; your User Content does not violate any law or any third-party rights (including privacy, publicity, copyright, or trademark); and any person depicted in your content is at least 18 years old (or the age of majority, as applicable) and has consented to being depicted and for the content to be posted.

6.4 Removal of Content. We may remove or restrict access to User Content at any time if we believe it violates these Terms, our policies, or applicable law.

7. Prohibited Conduct

You agree not to (and not to encourage others to):

7.1 Illegal / Harmful Behavior

Use the Platform for any unlawful purpose.
Exploit, harm, or attempt to exploit or harm any person.
Solicit or promote illegal services (including trafficking, exploitation, or non-consensual services).

7.2 Safety / Harassment

Threaten, harass, stalk, intimidate, defame, or abuse others.
Share someone’s private information (“doxxing”) without explicit consent.
Engage in extortion, blackmail, or coercion.

7.3 Non-Consensual or Sexual Content Misuse

Upload or share non-consensual intimate imagery (including “revenge porn”), hidden-camera content, or any content obtained without permission.
Depict violence or coercion in a sexual context in a way that violates law or encourages harm.

7.4 Platform Integrity

Attempt to bypass security, scrape profiles, harvest data, reverse engineer, or interfere with the Platform.
Use bots, automation, or scripts to access or manipulate the Platform without our prior written permission.
Introduce malware or harmful code.

7.5 Spam and Misuse

Send spam, solicitations, or commercial promotions without permission.
Create accounts for the purpose of scamming, phishing, or fraudulent activity.

8. Community Safety, User Interactions, and No Background Checks

8.1 User-to-User Interactions. The Platform facilitates user interactions but does not guarantee the identity, intent, or conduct of any user.

8.2 No Background Checks. Swingtap does not routinely conduct criminal background checks and makes no representations regarding user conduct.

8.3 Assumption of Risk. You assume all risks associated with interacting with other users, including meeting in person. Use appropriate judgment and take reasonable precautions.

9. Intellectual Property

9.1 Platform IP. The Platform, including its software, design, text (excluding User Content), graphics, trademarks, logos, and other content are owned by Swingtap or its licensors and are protected by intellectual property laws.

9.2 Limited License. Subject to compliance with these Terms, Swingtap grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes.

9.3 Restrictions. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Platform except as expressly permitted by law.

10. Copyright Complaints (DMCA)

If you believe content on the Platform infringes your copyright, you may submit a notice to sales@swingtap.fun with:

Identification of the copyrighted work;
Identification of the allegedly infringing material and its location;
Your contact information;
A statement of good faith belief;
A statement under penalty of perjury that the information is accurate and you are authorized to act; and
Your physical or electronic signature.

We may remove content and/or terminate repeat infringers where appropriate.

11. Privacy

Our collection and use of personal information are described in the Privacy Policy. By using the Platform, you consent to those practices.

12. Third-Party Links and Services

12.1 External Links and Competitor URLs; User Responsibility

Users may include links to external websites, including other social or dating platforms, in their Swingtap profiles. Users are solely responsible for the content, legality, and safety of any external links they post.

12.2 No Affiliation or Endorsement

Swingtap is not affiliated with, sponsored by, or endorsed by any external websites, including competitor platforms. Posting an external URL does not imply any endorsement or partnership between Swingtap and the linked website.

12.3 Moderation and Removal

Swingtap reserves the right, at its discretion, to remove any external links that violate these Terms of Service, contain illegal or malicious content, or are reported as inappropriate.

12.4 Disclaimer of Liability

Swingtap is not responsible for the content, privacy practices, or safety of external websites. Users access all external links at their own risk.

12.5 No Tracking of External Links

External URLs may not contain tracking codes, referral links, or other identifiers that imply traffic originates from Swingtap without explicit approval.

12.6 Third-Party Services (General)

The Platform may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” SWINGTAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SWINGTAP (OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWINGTAP’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE AMOUNT YOU PAID TO SWINGTAP FOR THE PLATFORM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Swingtap and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

Your use of the Platform;
Your User Content;
Your violation of these Terms; or
Your violation of any rights of another person or entity.

16. Termination and Suspension

16.1 Your Right to Stop Using. You may stop using the Platform at any time. You may request account deletion by contacting sales@swingtap.fun.

16.2 Our Right to Suspend/Terminate. We may suspend or terminate your access immediately, without notice, if we believe you violated these Terms, pose a risk to others, or if required by law.

16.3 Effect of Termination. Upon termination, your license to use the Platform ends. Sections that by their nature should survive (including IP, disclaimers, limitation of liability, indemnification, and dispute provisions) will survive.

17. Dispute Resolution; Binding Arbitration; Class Action Waiver

17.1 Informal Resolution First. Before filing a formal claim, you agree to contact us at sales@swingtap.fun and attempt to resolve the dispute informally.

17.2 Binding Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding arbitration on an individual basis.

17.3 Class Action Waiver. You and Swingtap agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding.

17.4 Small Claims / Injunctive Relief. Either party may seek relief in small claims court for eligible matters. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse of intellectual property or unauthorized access to the Platform.

17.5 Location and Procedures. The arbitration will be conducted in Pinellas County, Florida, unless the parties agree otherwise (including remote proceedings where permitted). The arbitrator may award any relief that a court could award on an individual basis, subject to these Terms.

17.6 Time to Bring a Claim. To the extent permitted by law, any claim must be brought within one (1) year after the claim arises, or it is permanently barred.

18. Governing Law

These Terms are governed by the laws of Florida, United States, without regard to conflict-of-law principles.

If you are a consumer in a jurisdiction that provides mandatory consumer protections, nothing in these Terms is intended to limit those rights.

19. Changes to These Terms; Effective Date

We may update these Terms from time to time. We will post the updated Terms and revise the Effective Date within this section. Your continued use of the Platform after changes become effective constitutes acceptance.
